The European Commission has designated ChatGPT as a Very Large Online Search Engine under the Digital Services Act.
The August 31 decision puts ChatGPT into the DSA’s highest-scrutiny category for search services. Reddit and Roblox were designated as Very Large Online Platforms in the same announcement.
The trigger is scale. The Commission says the services declared that they reach at least 45 million average monthly users in the European Union. After notification, the designated services have four months, until January 2027, to meet additional DSA obligations.
ChatGPT is being regulated like infrastructure
The designation matters because it treats ChatGPT as a large information-access system, not only as an AI product. The DSA obligations for very large platforms and search engines include assessing and mitigating systemic risks tied to illegal content, minors, physical and mental well-being, fundamental rights, elections, and public security.
That is broader than a model-safety checklist. It pushes OpenAI toward a platform-governance posture in the EU, where the questions include how the service ranks or retrieves information, how users are exposed to harmful or illegal material, and how the company documents risk mitigation.
For AI companies, this is one of the clearest signs that consumer AI assistants are moving into the same regulatory category as large social, search, and marketplace systems when they reach enough users.
The deadline is short
January 2027 is close in product-governance terms. OpenAI will need to show more than a public safety policy. The DSA’s very-large-service regime is built around risk assessments, mitigation measures, auditability, transparency, and supervisory access.
The Commission’s announcement does not say that ChatGPT violated the DSA. It says ChatGPT is now large enough in the EU to face the additional obligations attached to the designation.
That distinction matters. This is not an enforcement penalty. It is a threshold event that changes the compliance surface for OpenAI.
AI search is becoming a policy category
The VLOSE label is especially important because AI assistants increasingly answer questions that used to go through search engines. A user may ask ChatGPT for product research, legal context, health information, political background, or breaking-news interpretation without seeing the ranking machinery behind the response.
Regulators are now asking whether that kind of answer surface should be governed like search when it reaches search-like scale. The European Commission’s answer, for ChatGPT in the EU, is yes.
That creates a precedent other AI companies should watch. Gemini, Claude, Perplexity, Copilot, and future agentic browsers all face the same structural question: when an AI system mediates access to information for tens of millions of people, model behavior becomes platform behavior.
