Oracle has sent a force majeure notice to the developer of Project Jupiter, a New Mexico data center campus associated with Stargate, according to a TechCrunch report citing Bloomberg. The notice could let Oracle delay payments if the site misses its 2028 operating target. Oracle says the project remains on schedule, and Blue Owl Capital, whose unit received the notice, says its financial commitments have not changed.
The notice matters because the site’s planned power supply has several dependencies. TechCrunch reports that the 2.45-gigawatt campus is intended to run on gas-powered fuel cells from Bloom Energy. A pipeline planned to supply gas has been delayed to February 1, 2027 after permit denials. The air-quality permit for the fuel cell system is also pending, with a November 23 decision deadline reported by TechCrunch.
The contract and construction clocks differ
A force majeure notice sets up a contractual position if a qualifying event disrupts obligations. It does not itself establish that the campus will open late. Oracle’s statement says Project Jupiter is on its planned schedule. Blue Owl’s statement says the notice does not change its financial commitments.
The practical question is whether the pipeline, fuel-cell permitting, construction, and commissioning can all fit before the 2028 target. Oracle has publicly described Project Jupiter as an active construction project with hundreds of New Mexico residents working onsite. Work at the site can advance while the energy supply remains unresolved.
